Competition Terms and Conditions

Participation in this game of skill competition (Competition) is deemed acceptance of these terms and conditions (Terms).
1. Promoter: The Competition is run by Te Ara Kaihanga Limited (NZBN 9429051239312) (Promoter, us, we).
2. Competition Type: This Competition is a game of skill, and chance plays no part in determining the Winner. Each entry will be individually judged based on the literary and creative merit of the answer provided to the Competition Question.
3. Competition Question: The Competition question is “Why should you win this Competition, and how will winning this Competition impact your home and whānau?” (Competition Question).
4. Entrant Requirements: Entrants must be New Zealand residents and aged 18 years or over (Entrant).
5. Ineligible Entrants: Professional gamers are ineligible to enter this Competition. Inaudible, incomprehensible, and incomplete entries may also be deemed invalid.
6. Maximum Entries: Each Entrant is permitted to submit only one entry per residential home/property.Multiple entries from the same Entrant or in connection with the same residential home/property will not be accepted by the Promoter and may result in disqualification from the Competition.
7. Residential Home/Property: The residential home/property must be located within the area between North Auckland to Far North, New Zealand.
8. Number of Winners: There will be only one (1) winner (Winner).
9. Competition Period: The Competition commences on 9.00am 24 October and closes at 11.59pm on 23 November 2025 (Competition Period). Only entries received by the Promoter during the Competition Period will be considered. Entries are deemed to be received at the time of receipt by Promoter, and not at the time of transmission by the Entrant. Entries received outside by the Promoter the Competition Period, will be deemed invalid.
10. Prize: The Winner will receive $15,000 (excluding GST) worth of roofing services, plus edge protection scaffolding valued at $2,500 (excluding GST) for the Winner’s residential home/property (Prize). The Promoter accepts no responsibility for any variation in the value of the Prize.
11. Additional Expenses: Any additional expenses incurred as a result of entering the Competition and/or winning the Prize, are the sole responsibility of the Entrant and/or Winner.
12. Non-Transferability of Prize: The Prize is non-transferable or non-exchangeable and cannot be exchanged for cash or other goods/services, unless otherwise specified.
13. Prize Date and Judging of Winner: The Promoter’s staff members will judge the entries based on the quality, creativity, storytelling and community impact of the submission with reference to the judging criteria set out in these Terms. Judging will take place at 17 Kiripaka Road, Tikipunga, Whangarei 0112, New Zealand (Head Office) on 26 November 2025 at 9.00am (Judging Date). The Winner as judged by the Promoter will win the Prize.
14. Deposit: To confirm entry into the Competition, Entrants must pay a 50% deposit of the total roofing contract quoted value (Deposit). All Deposits will be held in a separate trust account by the Promoter until the Competition concludes. The Winner will receive the Prize as credit toward their roofing contract with the Promoter. All other Entrants’ roofing contracts will proceed as quoted, and their Deposits will be applied towards their roofing contract with the Promoter as normal.
15. Winner Eligibility: To be eligible to win, Entrants must submit a response to the Competition Question and fill out the questionnaire via the Promoter’s website https://www.tearakaihanga.nz/roofing-15000-competition (Website), sign a roofing contract with the Promoter valued at $15,000 (excluding GST) or more, and have their deposit paid, all by 11.59pm on 23 November 2025. Entrants must all provide correct and accurate information in their entry details and submit a short written or video statement responding to the Competition Question.
16. Notification of Winner: The Winner will be personally notified via telephone and email, and their names will be published on our Facebook and Instagram pages) within 1 days of the Judging Date.
The Winner must redeem the Prize by 11.59pm on 31 January 2025. The Winner is solely liable for checking their emails, responding to telephone calls and providing any further details required by the Promoter to deliver the Prize, and redeeming the Prize. The Promoter will not be liable for any losses incurred by the Winner for errors or inaccuracies in the details provided by the Winner or any failure to redeem the Prize, including where the Prize expires due to acts or omissions of the Winner. The Promoter will not provide any replacement Prize. Any failure to redeem the Prize by its expiry date will be considered a forfeiture of such Prize by the Winner. A new Winner will not be re-drawn once a Winner is notified or if the Prize is uncollected.
17. Proof of Identity: The Promoter reserves the right to request the Winner to provide proof of identity or proof of residency at the address specified in their submission in order to claim the Prize. Proof of identification and residency is at the absolute discretion of Promoter. In the event that the Winner cannot provide suitable proof, the Winner will forfeit the Prize.
18. Site Verification: The Promoter reserves the right to conduct reviews using Google Earth and/or carrying out short site inspections, to confirm eligibility.
19. Disqualification of Entrants: The promoter reserves the right, in its sole discretion, to disqualify any Entrant that has, or is suspected by the Promoter to have:
a. breached any of these Terms;
b. tampered with the entry process or the Competition;
c. engaged in any unlawful and/or dishonest conduct; and/or
d. engaged in any other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition and/or the reputation of Promoter.
20. Entrant Content: Entrants agree that they are fully responsible for any materials they submit via the promotion including but not limited to comments, recordings and images (Content). The Entrant agrees to grant the Promoter, its affiliates, licensees and successors a non-exclusive, royalty-free, perpetual, irrevocable, worldwide and fully sub-licensable right to use, communicate, reproduce, modify, adapt, publish, publicly perform, translate, create derivative works from, distribute and display in any form, any such Content, including but not limited to text, images, videos, graphics, audio and photographs without attribution. The Promoter shall not be liable in any way for such Content to the fullest extent permitted by law. Entrants warrant and agree that:
a. they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 18, or otherwise unsuitable for publication;
b. their Content shall not contain malware or cause injury or harm to any person, entity, or the Website;
c. they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;
d. the Content is the original literary work of the entrant that does not infringe the rights of any third party; and
e. they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
21. Personal Information: The Promoter collects personal information (PI) in order to conduct the Competition and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors and service providers. Entry is conditional on Entrants providing this PI. The Promoter will also use, and handle PI as set out in its Privacy Policy, which can be viewed at https://www.tearakaihanga.nz/privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how Entrants may opt out, access, update or correct their PI.
22. Termination and Modification: The Promoter may, in its absolute discretion, modify, cancel, terminate, suspend or recommence the Competition. The Promoter may administer this Competition in the manner that it considers appropriate in accordance with New Zealand law, including where the Competition is not capable of running as planned, such as where there has been infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of the Competition. To the maximum extent permitted by law, Promoter will not be held liable for any error, omission or failure to administer this Competition.
23. Warranties: Except for any rights you may have under the Consumer Guarantees Act 1993 and/or the Fair Trading Act 1986 (which cannot be excluded by law), all warranties, conditions and representations (whether express, implied, statutory or otherwise) relating to the Competition, are excluded.
24. Limitation of Liability: To the maximum extent permitted by law, the Promoter (including its affiliates and sub-licensees, and their directors, officers, employees, representatives and agents) is not responsible for any losses, costs, damages or expenses (whether direct, indirect, incidental or consequential) arising from your participation in the Competition, including but not limited to:
a. late, lost or misdirected entries including due to technical disruptions, delayed or misplaced postage, network congestion or for any other reason;
b. inaccurate or incorrect transcription of entry information;
c. any technical difficulties or equipment malfunction, malfunction of any telephone network or lines, computer online systems or network, servers or providers, computer equipment, or software (whether or not under the Promoter’s control);
d. the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the Internet or at any website, including the Website;
e. any theft, unauthorised access or third party interference;
f. electronic or human error which may occur in the administration of the Competition;
g. any variation in Prize value;
h. any tax liability incurred by the Winner and/or an Entrant;
i. redemption or use of the Prize;
j. change, reduction, suspension or withdrawal of the Competition;
k. amendments to these Terms; and
l. any circumstances or events beyond the Promoter’s reasonable control.
25. Time Zone and Currency: These Terms, any references to times or dates refer to New Zealand Standard Time (NZST) and any references to currency, such as “dollars” or “$” refer to New Zealand Dollars.
26. Amendments: The Promoter may amend these Terms at any time, and for any reason. Any changes will take effect immediately upon posting on the Website. It is your responsibility to review the most recent version of the Terms on the Website before, and while participating in the Competition.
27. Waiver: Failure by the Promoter to enforce any of its rights under these Terms, does not constitute a waiver of those rights.
28. Governing Law and Jurisdiction: The Competition and these Terms are governed by and will be construed under the laws of New Zealand, and the parties agree to submit to the exclusive jurisdiction of the courts of New Zealand.
